 Brian Trachtenberg is an associate in the litigation section of Porter & Hedges. Drawing on his early experience as a business transactions attorney with a focus on closing complex real estate matters, Brian is particularly adept at litigating, arbitrating and counseling his clients regarding complex contract disputes that often, though do not necessarily, involve a property dispute component, including disputes over real estate, intellectual property and securities ownership. Many of Brian's recent matters also have involved defending partners and partnerships against claims brought by one or more other partners. Recently, for example, Brian obtained a complete dismissal of claims brought by a limited partner against a hotel development partnership, and drafted and filed appellate briefing pending in the same matter in the Fourteenth Court of Appeals of Texas. Brian also has experience with energy disputes, employment matters and insurance issues, and with litigation filed in state and federal courts, domestic and international arbitration, and mediation. - Defended employee and his new employer against claims brought by former employer alleging breach of a non-competition agreement, resulting in the withdrawal of all claims by the former employer.
- Defended international chemical company against breach and fraud claims arising out of fires alleged to have been caused by client's product, resulting in favorable settlement.
- Represented oil and gas exploration and development company in claims against its insurer arising out of damage suffered by a well due to Tropical Storm Allison.
- Represented Canadian manufacturing company in a 5-week arbitration against seller of manufacturing facility and natural gas provider concerning the terms of a gas sales agreement subject to Alaskan law, resulting in favorable judgment for client.
