Charles Baker has over 20 years of experience in prosecuting and defending complex civil litigation matters, with emphasis on matters involving fraud, breach of contract, unfair competition, securities and related commercial matters. In addition, his litigation experience includes significant high-profile work on intellectual property matters, such as patent litigation, copyright litigation, trademark litigation and trade secret litigation.  Mr. Baker has obtained several landmark victories in the still-evolving area of software copyright law.  His litigation experience has expanded to pharmaceutical defense and he has arbitrated a number of cases across the United States.  He is listed as one of America's leading lawyers for intellectual property by Chambers USA, and has been selected as a "Texas Super Lawyer" in Intellectual Property Litigation by surveys conducted by Texas Monthly since 2005.  In 2008, Mr. Baker was listed in Super Lawyers, Corporate Counsel edition in the area of Intellectual Property Litigation.

Prior to joining Porter & Hedges, Mr. Baker  was a partner at Brobeck, Phleger & Harrison, LLP.  Early in his career, he honed his intellectual property litigation skills at the IP firm of Arnold White & Durkee (now Howrey Simon Arnold & White) where he was a shareholder trying intellectual property lawsuits.

Representative Experience

  • Mr. Baker's clients range from FORTUNE 500 companies to high tech start-ups. His experience includes cases in both state and federal courts involving a wide range of industries including computers, computer software, telecommunications, medical device manufacturers, oil and gas, semiconductors, restaurants, retail stores, financial institutions, pharmaceutical companies and FORTUNE 500 companies. He is skilled in all aspects of pretrial discovery and has tried many cases to verdict, including several preliminary injunction matters. He has also argued several cases in the United States Court of Appeals for the Fifth and Ninth Circuits as well as Texas appellate courts.  He has also appeared before the U.S. Supreme court in the landmark decision MGM v. Grokster.
