J.T. Nesser is a senior associate in the litigation section of the firm. Mr. Nesser is licensed in both Texas and Louisiana.  His experience includes representing public corporations, private companies, and individuals as plaintiffs and defendants in complex trials in state and federal courts in Texas and Louisiana, and before arbitration panels of the American Arbitration Association.  He has been named a "Texas Rising Star" in surveys conducted by Texas Monthly magazine in 2007 and 2008.

Mr. Nesser has experience in:

• commercial litigation, including breach of contract claims and business torts
• energy litigation, representing both operators and service contractors
• construction litigation
• complex insurance coverage disputes

Mr. Nesser also participated in the two-week trial training program sponsored by the National Institute for Trial Advocacy (NITA) in Louisville, Colorado in July 2008.

Representative Experience

• Representation of offshore construction company in seven-week federal court trial and eight-week arbitration in an approximately $300 million deferred production case involving the failed installation of an offshore production platform.
• Representation of plaintiff energy company in breach of contract arbitration against an offshore platform operator for improper allocation of production and related revenue.
• Representation of marine survey company in numerous commercial and personal injury disputes.
• Argued and briefed insurance coverage dispute to the United States Fifth Circuit Court of Appeals.
• Representation of plaintiff corporation as second chair attorney in breach of contract dispute involving marine construction contract and complex insurance coverage issues.
• Representation of multi-family apartment complex owner against plumbing subcontractor in arbitration involving breach of contract and breach of warranty claims.
• Representation of offshore construction company in multi-million dollar insurance coverage claim relating to the loss of installation equipment onboard a cargo barge that capsized off the coast of Argentina.
• Representation of sole heir and estate in wrongful death claim against trucking company.
