Mr. Cohen’s practice focuses on products liability, asbestos litigation, general negligence, contract disputes and lease disputes. He has also handled medical malpractice, employment discrimination and sexual harassment lawsuits. Mr. Cohen has tried cases to jury verdict as both first and second chair counsel, has had a significant motion practice, and has presented over one hundred cases at mediation. He has defended suits in numerous counties in Texas and in Louisiana, Alabama, Florida, Pennsylvania, New Mexico and New York. Mr. Cohen has been named a “Texas Rising Star” in surveys conducted by Texas Monthly magazine from 2005-2007.
Prior to joining Porter & Hedges, Mr. Cohen was of counsel at Vinson & Elkins, L.L.P. in Houston. Representative Experience
Products Liability
- Represented a major pharmaceutical manufacturer in multiple lawsuits arising from the use of two prescription drugs including active development of all aspects of cases as well as assisting in the supervision of entire case docket.
- Represent a major pharmaceutical manufacturer in lawsuits arising from the use of an over-the-counter medication.
- Represented multiple product manufacturers, employers and premises owners in cases arising out of asbestos and chemical exposure, including being a trial team member in multiple asbestos jury trials.
- Responsible for handling of matters before Rule 11 Pre-Trial Judge (for region of state covering more than 30 counties) on behalf of major pharmaceutical manufacturer including handling of proceedings involving entry of a Master Pre-Trial Management Order.
- Represented tire manufacturer in multiple wrongful death and personal injury suits filed throughout state relating to rollover accidents and product recall.
Premises Liability
- Over ten years experience representing and counseling landowners and property managers in premises liability lawsuits including successful jury trials of suits against two companies.
- Assisted major oil company in evaluating existing premises liability suits after merger with another major oil company.
Trucking
- Over eight years of experience representing and counseling various trucking companies in wrongful death and catastrophic injury lawsuits and claims.
Contract and Lease Disputes
- Represented numerous residential property management companies and successfully tried numerous lease disputes to juries and to bench.
- Represented major oil company in numerous contractual disputes with distributors and retail outlets throughout country.
- Assisted major oil company in evaluating existing contractual disputes after merger with another major oil company.
- Represented small business owners and successfully tried breach of contract disputes on behalf of two of these companies.
Other Matters
- Represented numerous physicians, dentists and health care facilities in cases involving allegations of malpractice including successful jury trial of dental malpractice case.
- Represented employer in handling of Age Discrimination in Employment Act suit including participation in trial that resulted in directed verdict on behalf of employer.
- Represented employer in multiple sexual harassment suits and obtained dismissal with prejudice of one suit after proving that plaintiff had forged documents that she claimed supported her claim.
- Represented insurer and claims administrator for a voluntary benefits plan subject to ERISA and obtained settlement for 1/10th of original demand given pending ruling on Motion for Summary Judgment.
