Porter & Hedges Expands Litigation Practice With the Addition of Four Partners From Jenkens & Gilchrist 2/27/2007 Houston - - Porter & Hedges announces today that four lawyers from Jenkens & Gilchrist's Houston office will join the firm's litigation group. The new members bring a roster of national clients and highly skilled experience in the areas of construction, bankruptcy, creditor's rights, railroad, transportation, environmental, franchise, product liability, civil, commercial and personal injury.

Daniel V. Flatten, Partner: Mr. Flatten's litigation practice emphasizes commercial, railroad and transportation, environmental, product liability, employment and insurance issues. Mr. Flatten is a Fellow of the American College of Trial Lawyers, an Advocate of the American Board of Trial Advocates, and past chair of the Texas Board of Legal Specialization. He received a B.A., with honors in 1964 from University of Texas, and a J.D., from the University of Texas School of Law in 1966.
Nicholas Simms, Partner: Mr. Simms is a litigator whose practice focuses on general commercial, construction, international, and creditors' rights. In the general commercial area, Mr. Simms has represented plaintiffs and defendants in disputes over asset/stock purchase and merger agreements. In the construction area, Mr. Simms has represented general contractors and subcontractors in a wide variety of disputes. Mr. Simms' international experience consists of representing foreign companies in disputes in the U.S. and assisting U.S. companies in proceedings in foreign tribunals. He received a B.B.A., in 1992 from the University of Nevada, Las Vegas, and a J.D. in 1995, from Baylor University School of Law.
Kerry McMahon, Partner: Mr. McMahon is a civil litigator whose practice is concentrated on construction matters and commercial disputes. He has represented various commercial entities and individuals in business litigation in both state and federal trial and appellate courts. His experience includes both plaintiffs' and defendants' representation in suits involving anti-trust issues, creditors' rights, commercial lending, landlord's and tenant's rights, oil and gas, construction contracts, fraud, and other business torts. Mr. McMahon also has experience in bankruptcy litigation. He received a B.A., from Baylor University in 1992, and a J.D. from Texas Tech University in 1996.
Clay M. Steely, Partner: Mr. Steely specializes in real property, commercial and personal injury litigation. He has tried a variety of cases to a verdict and has handled appeals before the Texas Court of Appeals, the Texas Supreme Court and the U.S. 5th Circuit Court of Appeals. His real property experience includes disputes involving airborne, surface and groundwater releases or other invasions (negligence, gross negligence, negligence per se, trespass, and nuisance), lease and easement interpretation, condemnation issues, as well as lease and sale negotiations. His commercial experience includes claims involving breach of oral and written contracts, sales contracts (including claims involving the Uniform Commercial Code), equipment lease disputes, writs of sequestration/possession, as well as employment matters (employment agreement, non-compete, and termination issues). Mr. Steely also represents franchisors in cases involving vicarious liability, forcible entry and detainer, breach of contract, deceptive trade practices, misrepresentation and fraud issues surrounding Uniform Franchise Offering Circulars, franchise agreements/contracts and the franchisor/franchisee relationship as a whole. His personal injury experience includes work related accidents, products liability claims, premises claims, and subrogation issues involving injuries ranging from soft tissue, to operated backs, to death.
