Porter & Hedges Wins Arbitration for EXi Parson Telecom
Porter & Hedges successfully represented EXi Parsons Telecom ("EXi") in an arbitration filed by GTL in regards to the construction of several telecommunications sites.
EXi submitted various contracts to GTL in connection with the sites. GTL failed to sign and return the contracts to EXi. Subsequently, EXi sent the contracts to a third party, Xcell, to perform the necessary work. Previously, Xcell had acted only as GTL's subcontractor for EXi projects. Xcell performed the necessary work and was compensated directly by EXi.
GTL later filed an arbitration claim against EXi contending it had an implied contract and that Xcell acted as GTL's subcontractor in the performance of the requested work. At the arbitration, EXi was represented by litigation associate Amy Wolfshohl. The result of the arbitration was a denial of GTL's clain and EXi was awarded its attorneys fees and costs for the arbitration defense.
