Texas law allows contract parties to disclaim tort liability – sometimes. Texas courts and unhappy contract parties have wandered through this legal minefield, attempting to define when tort claims may be effectively disclaimed, and when they are not, with inconsistent results. Should your client agree to that disclaimer? Will a Texas court enforce it?
